No. 73 (Kamloops/Thompson), October 7, 2006 (Dorsey)
This decision is a preliminary award dealing with the
production of a harassment report. The Union grieved alleged harassment
of an employee by a manager, and then sought production of a report concerning
the harassment done by an employer appointed investigator. The manager
was represented at the hearing and argued that the Union should only receive
a severely edited version of the report. The Employer argued that there
should be elaborate procedures followed before anything was produced to
the Union. The arbitrator rejected both of these positions and accepted
the Union’s argument that the report should simply be produced to
the Union with conditions on its use.
