Michael Nolin et. al, –and– Wal-Mart Canada Corp –and– United Food and Commercial Workers Union Local 1518, BCLRB No. B55/2007 (leave for reconsideration of BCLRB No. B123/2006)
The Union was conducting an organizing campaign at the Wal-Mart in Dawson Creek. One employee contacted Mr. Nolin, a labour lawyer in Saskatchewan, for advice in fighting the Union’s organizing efforts. Mr. Nolin provided a letter which he told the employee to distribute. The Board found that Mr. Nolin breached the Code as his letters included statements that were intimidating and coercive, principally that the employees could lose their job by unionizing. The letter also contained numerous inaccurate statements about the law and the conduct of the Union.
