Willi Speitelsbach –and- The Board of Trustees of Local 213 Electrical Workers’ Pension Plan –and- IBEW 213, BCLRB No. B133/2004. In this case the Board dismissed a complaint under section 9 of the Code...more

City of Surrey –and– Canadian Union of Public Employees, BCLRB No. B155/2004, the Board upheld a decision of an arbitrator finding that the City of Surrey did not have just and reasonable cause to terminate an employee’s employment. The Arbitrator found that the individual had acted inappropriately with respect to a couple of his fellow workers. While the conduct constituted sexual harassment, the Arbitrator held that the harassment was minor. The Employer appealed the arbitrator’s decision on a number of grounds, including alleging that the arbitrator had misapplied the just cause standard and failure to consider the true substance of dispute. The Board dismissed all of the Employer’s grounds of appeal. The Employer also challenged some of the Arbitrator’s ruling on damages on behalf of the individual. The Board held that it did not have jurisdiction to review the award of damages for intentional infliction of mental suffering and defamation.
