Health Employers Association of B.C. –and– Hospital Employees’ Union, BCLRB No. B151/2004, HEABC applied to the Labour Relations Board seeking a declaration that the HEU had contravened the Essential Services Global Order and an order that the HEU cease and desist from contravening the global order. HEU raised three objections to the application: first, that Board did not have jurisdiction because HEABC was seeking to have the Board enforce its own orders; second, the Board does not have jurisdiction because HEABC is seeking injunctive relief from tortious conduct – only courts have jurisdiction over tortious conduct; and third, HEABC had not provided sufficient particulars to proceed with the application. The Board dismissed the application on the basis of the first two objections raised by HEU. The Board found that it did not have jurisdiction to grant relief from tortious conduct and that it could not enforce its own orders.
