Health Employers Association of British Columbia –and– United Food and Commercial Workers’ Union, Local 1518, August 13, 2004, unreported award of C. Sullivan. In this case the arbitrator denied a union grievance that the employer had violated the collective agreement in not returning an employee to her preferred worksite after she returned to union leave. The employee had returned to her former position and had received her normal hours but wanted to return to work at a specific clinic that she had helped to develop. The arbitrator found that the employer had not acted discriminatorily, that the employer was not bound by a previous settlement, and that the employer was not estopped from acting in the manner that it did.
