Sobeys Capital Incorporated, BCLRB No. B197/2005
The Employer operates a grocery store in Fort St. John. The UFCW applied for certification of a unit of all employees except those in the office and the meat department. The Labour Relations Board found that the bargaining unit sought by the UFCW was an appropriate unit even though the meat department employees shared some community of interest with employees within the unit. The Board concluded that there was no functional integration between the meat department and other departments that served to defeat the application. The Board also rejected the Employer’s argument that the many grocery store certifications held by the UFCW which exclude the meat department reflected the distinct nature of meat cutting work in the past and were no longer appropriate given the contemporary nature of the work. The Board went on to conclude that Sobey’s discharged an employee without proper cause after the UFCW application was filed and ordered that the ballot she cast in the vote must be counted. Finally, the Board said that the ballots cast by an employee who was going to retire and certain new hires should be counted, but that a ballot cast by an employee on an indefinite medical leave should not.
