Compass Group Canada (Health Services) Ltd., BCLRB No. B200/2005
The HEU applied to represent employees of Compass at sites operated under the auspices of the Provincial Health Services Authority (“PHSA”). Compass and the Steelworkers, Local 1-3567 objected to the application on the basis that the employees in question were covered under two voluntary recognition collective agreements and that the HEU application therefore amounted to an untimely raid application. In addition, Compass argued that the bargaining unit sought by HEU was not an appropriate unit because it included employees in two separate business divisions. The Board granted the HEU application. The Board applied the Army & Navy analysis and found that the application is not a raid because the HEU unit included two entities which were treated separately for labour relations purposes. In addition, the Board found that the unit sought by HEU was an appropriate unit because the employees in the separate divisions were working for the same client, the PHSA, at the same worksites.
