Select July 2004 Decisions Hudson Bay Company –and– United Food and Commercial Workers’ Union Local 1518 BCLRB No. B226/2004 This case with a bad faith bargaining complaint filed by the Union as a result of the employer’s refusal to provide the Union with employee contact information as well as wages and benefits during collective bargaining. The Employer relied on the recently enacted privacy legislation, Personal Information and Privacy Act, as a defense. The Board held that the information requested was authorized by law and therefore information that could be provided, and had to be provided, without breaching the privacy legislation.
