of BCLRB No. B345/2003)
This is an important policy decision of the
Labour Relations Board concerning unfair labour practices under the Liberal
amendments to the Labour Relations Code. The Union was engaged in an organizing
campaign at a large call center employing over a thousand employees. The
Union filed a complaint that the employer had violated the Code by various
actions, including by holding large employee meetings concerning the organizing
campaign in the workplace during working hours, having a team of managers
distribute daily gifts emblazoned with anti-union messages to employees
at their workstations, and dimming the lights and projecting anti-union
messages on the walls of the workplace for days on end. The original panel
found that none of these actions violated the Code. The Union applied
for reconsideration and in this decision the reconsideration panel found
that both the projected messages and the gift distribution constituted
unfair labour practices. The issue of remedy for these violations was
remitted back to the original panel to decide.
