The Original Panel had improperly dismissed the variance as a result of its conclusion that the H.E.U.’s existing bargaining unit had been cancelled solely because the employer had lost a contract which resulted in the loss of employment of the employees in the initial bargaining unit. The Board remitted the matter back to the Original Panel to determine the merits of the variance application. To view a copy of the decision in Adobe Acrobat format, please click here.
