RMH Teleservices International Inc. –and– British Columbia Government and Service Employees’ Union, BCLRB No. B280/2005. This case concerned the remedies that should be awarded for unfair labour practices committed by the employer over two years previously when the Union was engaged in an organizing campaign at a large call center employing over a thousand employees. The Union filed a complaint that the employer had violated the Code by various actions, including by holding large employee meetings concerning the organizing campaign in the workplace during working hours, having a team of managers distribute daily gifts emblazoned with anti-union messages to employees at their workstations, and dimming the lights and projecting anti-union messages on the walls of the workplace for days on end. The original panel found in BCLRB No. B345/2003 that none of these actions violated the Code. The Union applied for reconsideration and in BCLRB No. B188/2005 the reconsideration panel found that both the projected messages and the gift distribution constituted unfair labour practices. The issue of remedy for these violations was remitted back to the original panel to decide. In this decision the original panel ordered that the employer pay the Union for organizing costs, provide the Union with access to its property for 3 months, mail out Union campaign literature to all its employees, provide the Union with the names of all its employees, and post a summary of the Board’s decision in the workplace.
