He had been off work for slightly over a month... more Linda Christopherson –and– Dock and Shipyard Workers’, Local 1204 –and– Victoria Shipyards Co. Ltd., BCLRB No. B314/2004. An employee complained that she was subjected to continual workplace harassment and that after complaining to the Employer about the harassment that it began to discriminate against her. She also complained that the Union did not properly represent her in the grievances she filed over the harassment and discrimination. After reviewing the evidence presented by the complainant, the Board ruled that there were no credible assertions if improper conduct by the Union or the Employer. The Board held that the individual’s spurious allegations were likely driven by her personal animosity towards one of her co-workers. The Board found that her evidence was for the most part intentionally misleading and deceptive. Consequently, the Board dismissed the complaint on its merits.
